On December 30, 1965, Tafoya, together with his co-defendant Alberto Castro, pleaded not guilty to charges of kidnap and rape. Almost a year later, as a result of plea bargaining, they were permitted to withdraw their pleas. The kidnap charge was then dismissed, and they pleaded guilty to rape. The court followed the prosecutors recommendation that Tafoya be sentenced to three years, suspended, and that he serve two years on probation.
